Terms of Service

By creating an account or using Gear Depot, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the marketplace.

You must be at least 18 and a resident of the United States. Gear Depot is a US-only marketplace. One person may hold one account; accounts may not be transferred or sold.

You are responsible for what happens under your account, for keeping your credentials secure, and for the accuracy of the information you give us. You must verify your email address before you can check out. We may suspend or close an account that violates these terms, that we reasonably believe is being used for fraud, or that puts other members at risk.

Every listing is reviewed by our staff before it goes live. When you list, you confirm that:

• You own the item, or you are authorized to sell it.
• The condition, specifications, and included items are described accurately, and the photos are of the actual item.
• The item is legal to sell and is not stolen, counterfeit, or subject to a lien.
• You can ship or hand over the item within the handling time you state.

Materially editing a live listing sends it back for review. We may decline, edit, or remove any listing.

Checkout is protected. Payment is captured and held — it is not released to the seller when you pay. When the item is delivered, a 72-hour inspection window opens. If you do not raise a problem in that window, funds become eligible for release to the seller.

Items sell on a first-paid basis: a listing stays available until an order is actually paid for. Adding an item to your cart or having an accepted offer does not reserve it.

Browsing, listing, and buying are free. When an item sells, Gear Depot charges the seller a transaction fee of 5% of the item subtotal, with a minimum of $5 and a cap of $750. The fee is calculated on the item price only — shipping and insurance are excluded — and is deducted from the payout. Payment processing is handled by Stripe, whose own fees may apply to sellers.

Buyer protection, dispute handling, and payout guarantees only exist for orders that complete here. Do not use Gear Depot to arrange a sale that is paid for somewhere else, and do not exchange contact details in order to do so. Messages are screened for this, and attempts to move a deal off-platform can result in restrictions or account closure.

This is not a formality — off-platform payment is how buyers in this category get defrauded, and we cannot help you with a transaction we have no record of.

• Listing items you do not have, do not own, or cannot ship.
• Misrepresenting condition, authenticity, or what is included.
• Fraudulent payments, chargeback abuse, or money laundering.
• Harassment, threats, or abusive messages.
• Scraping, automated data collection, or attempts to break or overload the site.
• Manipulating reviews, offers, or search ranking.

Sellers are responsible for packing items properly and shipping within the stated handling time. Where you buy a label through us, tracking updates drive the order status and start the inspection window on delivery. Freight and local pickup follow the arrangements shown on the listing.

If an item arrives damaged, is not as described, or does not arrive, open a dispute within the inspection window. Payouts are paused while a dispute is open. Our staff review the evidence from both sides and decide the outcome, which may include a full or partial refund. Decisions are final as between you and Gear Depot.

You keep ownership of the photos and text you upload. You grant Gear Depot a non-exclusive, worldwide, royalty-free license to host, display, resize, and promote that content in order to operate and market the marketplace. You are responsible for having the rights to everything you upload.

We work to keep Gear Depot available, but we do not guarantee uninterrupted service. We may change, suspend, or discontinue features. The marketplace is provided on an “as is” basis to the fullest extent permitted by law.

Gear Depot provides the marketplace, the payment hold, and the dispute process. The sale itself is between the buyer and the seller. We review listings and verify sellers, but we do not take possession of items and we do not warrant them.

You may close your account at any time from account settings, subject to the record retention described in our Privacy Policy. You must first complete or resolve any open orders, payouts, and disputes.

We may update these terms. If a change is material we will update the effective date above and notify you. Continuing to use Gear Depot after a change means you accept it.
